Right of withdrawal

As of [January 1, 2026]
This page applies to consumers (B2C) who conclude distance contracts (online/by phone/email) via the BeGardenPro webshop. If you are purchasing as a business (B2B), the right of withdrawal may differ or not apply.


1) Your right of withdrawal within 14 days (general rule)

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

The 14 days begin:

  • For goods/products (sale) : from the day on which you (or a third party designated by you) received the goods.

  • For services : from the day the contract is concluded.

  • For subscriptions (service subscriptions) : from the date of conclusion of the contract (depending on the service/start date, see point 3).

  • For equipment rentals : generally from the date of contract conclusion; for scheduled handover/start, see point 3.


2) How to revoke (here's how)

To cancel, send us a clear statement within the deadline (email is sufficient):

3) Important note: Service must start within 14 days.

If you would like a service (e.g., maintenance/repair/gardening) or a scheduled service (e.g., delivery/setup/collection as part of the rental) to begin before the 14 days have expired , we usually require your explicit consent .

What does that mean for you?

  • If you still cancel, we can – to the extent permitted by law – charge a pro rata amount for the service provided up to that point.

  • If the service has been fully provided , the right of withdrawal may be forfeited under certain legal conditions, provided you have expressly agreed to this beforehand and acknowledged it.


4) Consequences of revocation – Sale of goods/products

If you cancel a purchase:

4.1 Return of goods

  • You must return the goods immediately or have them ready for return (depending on the instructions).

  • The goods should be handled as completely and carefully as possible.

4.2 Reimbursement

We will refund the payments received in accordance with legal regulations.

4.3 Depreciation

You only have to pay for a loss in value if the goods have been used beyond what is necessary to test their properties and functionality (as would be possible in a retail store).

4.4 Return shipping costs

You, as the consumer, bear the direct costs of the return shipment .
The return shipping costs correspond to the shipping costs that were displayed to you when you placed the order for the initial shipment (same pricing logic/same area).


5) Consequences of cancellation – Services & Subscriptions

If you cancel a service contract or subscription:

  • If no service begins within 14 days: You pay nothing for services not yet rendered.

  • If the desired start of services is within 14 days: We may – to the extent permitted by law – charge a pro rata amount for services already rendered.

Subscriptions: For subscriptions, the right of withdrawal generally applies from the date of conclusion of the contract. If you would like a subscription service to start immediately (e.g., first appointment/first maintenance), the information in point 3 also applies.


6) Cancellation policy for rented garden equipment – ​​special features

Rental bookings are generally subject to the 14-day right of withdrawal for distance contracts.
However, if you explicitly request that the rental/handover/service start before the end of the 14 days , point 3 applies (proportional costs possible; in the case of full service, the right of withdrawal may be void according to legal requirements).

Deposit (important):
The deposit is not a purchase price and is not retained as a "fee". It serves solely as security. If legitimate costs have already been incurred (e.g., pro-rata, permissible costs for services already rendered), these can be offset according to legal regulations.
